IMPORTANT: By entering the Gift Card Giveaway (“Sweepstakes”), presented by Coolinarco (“Sponsor”), you agree to the terms of these Official Rules, which are final and binding and govern over any inconsistent or prior terms or agreements.
- Date: The Sweepstakes will begin on July 19th at 6 AM Pacific Standard Time (the “Sweepstakes Period”).
- Eligibility: To participate in the Sweepstakes, you must:(a) be a natural person, at least 18 years old; (b) be a United States citizen or resident alien with a United States physical address; (c) be physically located within the United States; and (d) be physically located in a state which participation in the Sweepstakes is unrestricted by law. Persons in any of the following categories are NOT eligible to participate or win prizes in the Sweepstakes: any person who was or is: (a) a director, officer, employee, agent, or independent contractor of Sponsor or its parent company, subsidiaries, affiliates or service agencies; or any entities retained by Sponsor for the administration of the Sweepstakes; (b) an individual engaged in the development, production or distribution of Sweepstakes materials or the prize supply for the Sweepstakes; and (c) an immediate family member (defined as spouse, IRS dependent, or biological, adoptive or step- mother, father, sister, brother, daughter or son, and each of their respective spouses) of, or who resides in the same household as, any person in any of the preceding categories.
- How to participate/win: Anyone who views an advertisement containing details of the Sweepstakes and submits a recipe will automatically be entered into the Sweepstakes. No purchase is necessary and purchase does not increase the odds of winning. Only one entry per week per person is allowed. The winner is the one who has the most likes on their recipe on Coolinarco website by the end of the week (Sunday midnight). Winners will be announced on every Monday. It’s only possible to have one winner per week.
- Odds: Odds of winning are based upon the total number of eligible users who enter the Sweepstakes.
- Prizes: 200 USD gift card from either Williams Sonoma, Sur la Table or Le Creuset to each winner during the Sweepstakes Period (“Prize”). Sponsor or its agent will send a notification to the winners within five days of the end of the Sweepstakes Period. Once notified, the winner must claim the Prize within seven days. Failure to claim any Prize within the timeframe will result in forfeiture of the Prize. Potential winners may be required to complete and sign an Affidavit of Eligibility, release of liability, publicity release form (except where prohibited), and the eligibility of the potential winner will be verified. Forms must be returned within forty-eight hours of receipt by the potential winner. If any potential winner does not complete all forms necessary within the time given and/or in the event of non-compliance by any potential winner, such potential winner shall be disqualified and shall forfeit the prize, and all privileges otherwise due as a potential winner shall be terminated and an alternate potential winner may be selected. By entering or accepting any Prize, any winner allows Sponsor to use the winner’s entry, name, photograph, likeness, voice, opinions, Prize information, biographical information, hometown and state for publicity and promotional purposes without further compensation where permitted by law.
- Other Rules: The transfer of status as a winner by an ineligible person to an eligible person is strictly prohibited. No Prize substitutions or cash redemptions of any Prize or any portion thereof are allowed. Sponsor reserves the right in its sole discretion to substitute any prize or portion thereof of equal or greater value if any Prize is unavailable for any reason. The Sweepstakes is subject to all applicable federal, state, and local rules, laws, and regulations.
- Taxes: You can only win prizes up to an aggregate value of $500 (USD) during any calendar year. Sponsor’s systems may fail to restrict you to the above limitations due to circumstances out of its control, such as, but not limited to, when individuals file a joint tax return. In such an instance where you have won Prizes with an aggregate value of $600 (USD) or more during any calendar year, the United States Internal Revenue Service (“IRS”) regulations currently require Sponsor to send a Form 1099 to you. Accordingly, and in order to fulfill our legal requirements, if you receive Prizes in that amount during any calendar year, it is your responsibility to disclose that to Sponsor by providing a completed and signed IRS Form W-9, and to report such Prizes as income on your tax return regardless if you receive an IRS Form 1099. Although Sponsor will use commercially reasonable efforts to comply with and implement the IRS requirements accurately, promptly and fairly, you agree that neither Sponsor nor its related companies will be liable to you or any third party for any liabilities, damages, costs, or expenses of any kind and under any theory of law, equity, contract, tort or otherwise which you or such third party may incur as a result of any acts, errors or omissions of Sponsor or its related companies in their efforts to implement and comply with the IRS requirements. Without limiting the foregoing, you agree that you remain solely responsible for paying all federal and other taxes in accordance with the laws that apply in your state, province, and/or country of residence, and that you will indemnify and hold harmless Sponsor and its related companies from any and all liabilities, costs, expenses or damages incurred by any one or more of them as a result of (a) your failure to timely pay applicable taxes, or (b) inaccuracies or omissions in any W-9 or other IRS form which you submit to Sponsor.
- All information submitted in connection with entry to the Sweepstakes will be governed by the Sponsor’s privacy policy, located at the link. By entering the Sweepstakes, you acknowledge that you have read and agree to the privacy policy.
- DISCLAIMER AND LIMITATION OF LIABILITY: By competing in this Sweepstakes and/or accepting the Prize, you agree that Sponsor, and its respective parent companies, assigns, subsidiaries and affiliates, and advertising, promotion and fulfillment agencies and all of their respective employees, officers, and directors will have no liability whatsoever, and will be held harmless by entrants for any liability for any injuries, losses, or damages of any kind to person and property resulting in whole or in part, directly or indirectly, from the acceptance, possession, misuse, or use of any Prize, or participation in this Sweepstakes. By accepting a Prize, each Winner consents to the use of his/her name for publicity and promotional purposes on behalf of Sponsor with no additional compensation or further permission (except where prohibited by law). Sponsor disclaims all warranties associated with the Sweepstakes and Prize(s) and is in no manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any Prize, including any implied warranty of merchantability of fitness for a particular purpose. Sponsor will have no liability for any winner notification that is lost, intercepted or not received by a potential winner for any reason.
- YOU AGREE TO WAIVE A TRIAL BY JURY. Any dispute arising from this Sweepstakes will be governed by the laws of the State of California, without reference to its conflicts of laws principles. You agree that all disputes will be submitted to binding arbitration by one arbitrator in accordance with the then-existing Comprehensive Arbitration Rules and Procedures of JAMS.
- Where required by law, Sponsor will provide the name of the winner(s) of the Sweepstakes to those who request it. For the names of winners: (i) send a self-addressed, stamped envelope postmarked to insert address, Attn: Winner List; and (ii) write the name of the Sweepstakes on the lower left hand corner of the envelope. All requests for the names of the winners must be received within two weeks of the end of the Sweepstakes Period.
